A US judge has declared a mistrial in the case of an Australian student charged with assault for hitting a co-worker with a snowball.

Jurors were expected to reach a verdict in the trial of Andrew Thistleton on Friday, but new information led the judge to halt the trial.

The Sydney University and former Scots College student will face a new trial this week.

Authorities said Thistleton, 21, hit Michelle Oehlert with the snowball at the Copper Mountain ski resort on February 4. They both worked at Breeze Ski Rentals.

Andrew (the big meanie who threw the snowball) and Michelle (the poor little girl, er… woman, who got hit with the snowball) work in the rental department at Copper Mountain in Colorado where it was common for the employees to joke around, sometimes going as far as to throw a snowball or two. Oh the humanity!

What the hell is wrong with Michelle Oehlert? She got hit with a snowball. She’s not four years old. Brush off the snow and stop being a big f*&%ing baby. Great Flying Spaghetti Monster what is the world coming to!?!
